Canada Lawyers Face Funds Crisis over Tamil Immigrants

Lawyers in Canada appearing for a notorious group of Tamil immigrants have stated that they are running out of money for immigration cases.

An organization called Legal Services Society is helping the Tamil immigrants with legal representation at detention hearings.

On August 13 aboard the MV Sun 492 migrants arrived on Vancouver Island Area and most of them have been detained in the Vancouver area.

The funding revelation came during a Federal Court hearing in Vancouver into the government’s challenge of the release of a small number of migrants earlier this week, the Postmedia News reported.

Rod Holloway manager of Legal Services Society in a letter addressed to the lawyers representing the immigrants said that the society’s immigration funding is limited.

“The arrival of … Tamils who are currently detained has placed us in a position where funding their detention reviews … will, very shortly, exhaust our current resources allocated to immigration matters.”

The group’s executive director, Mark Benton, said the society budgeted USD 1.5 M for immigration cases this year, but that amount is based on an average of 700 to 800 refugee claims.

“We’ve got 490 more people than we expected,” he said.

The funding crunch is a serious issue as the migrants may be left without legal representation at detention hearings.

The migrants have applied for refugee status claiming that their lives are in danger or may have to suffer extreme discrimination as they are an ethnic minority in their native country Sri Lanka.

Establishing each migrant’s identity to the satisfaction of the Canada Border Services Agency is proving quite difficult. The CBSA is concerned that some members of the banned terrorist organization LTTE may mixed among the migrants.

The CBSA also is bearing extraordinary expenses by keeping the migrants in detention. It is paying B.C.’s correctional services more than USD 88,000 a day — about USD 200 per migrant — for a total of more than USD 3 M for their 34 days of incarceration so far.
